Are Only 2% of Sexual Assault Allegations False?

Actress Alyssa Milano has been among those espousing that only 2% of sexual assault allegations are false.

Ever since the #MeToo controversy broke out, there’s been a commonly repeated claim made across the social media sphere that only 2 to 8% of sexual assault allegations are false, and that because such a low number of reports are false, we ought to always believe women who report they were assaulted by default.  Even if not explicitly stated, what the people who report this are really saying is that since false allegations are so rare, the burden proof ought to be on the accused male to prove that he didn’t assault the female who is accusing him, not on the accuser to prove that he did. Even if the courts are ultimately unable to establish that he did commit the assault, we ought to assume he did anyways.

I should first point out that even if it is the case that only 2-8% of sexual assault allegations are false, it does not follow that we should therefore assume that all reports are true.  Every case needs to be evaluated on its own merits, the accused is innocent until proven guilty, and the burden of proof is on the person making the positive claim that it did happen.  If you deny this then you are denying your own right to due process the next time you are accused of committing a crime.

However, when you actually read from the studies that make this claim, it becomes clear immediately that specific definitions researchers are using have been chosen so as to make it seem like men are guilty of sexual assault far more often than they actually are.  So, let’s quick talk about the various possibilities that exist when a woman accuses a man of sexual assault.

When a woman claims she was sexually assaulted there are three possibilities about her claim.  Either she’s telling the truth, she’s deliberately lying, or she is sincerely mistaken for one reason or another.  But these three possibilities apply not only to her claim about the assault but also to her claim about who assaulted her.  It’s entirely possible, for example, that a woman was in fact sexually assaulted, but for one reason or another is mistaken about who assaulted her, and in such a case the woman would be telling the truth when recounting her assault, but none the less falsely accusing an innocent man.

But there are more possibilities as well.  There in principle could be a case where a woman was in fact sexually assaulted, but has chosen to accuse someone other than the person who assaulted her.  I don’t presume to know what the reasoning for that would be, but it is something that in principle could occur.  Now in this case, a woman could be truthfully recounting a sexual assault, but deliberately accusing a man who did not commit it.

As you can see, this issue is not as simple as either the accuser was assaulted by the person she is accusing, or she was not assaulted at all and is lying.  There are other possibilities, and very rarely will an investigation be able to definitively rule out all possibilities beyond the specific guilt or innocence of the accused.  For example, suppose in a particular case where a man is accused of sexual assault, evidence is presented that completely exonerates him, such as security camera footage that proves he wasn’t even in the city that the alleged assault took place in on the night it occurred.  In such a case, it would be established that the accused is innocent, but that doesn’t necessarily prove that no sexual assault occurred.  At this point the accuser could try and claim that she must’ve been mistaken about who assaulted her.  The innocence of the accused is not in and of itself, an admission by the accuser that no sexual assault occurred.

With all this in mind, what do the academics who have reported the 2-8% statistic actually mean when they say that only 2-8% of sexual assault allegations are false.  In their paper that was published in Violence Against Women and presented at the Symposium on False Rape Allegations, the researchers who made this claim said very clearly what they meant, “To classify a case as a false allegation, a thorough investigation must yield evidence that a crime did not occur” (Lisak, Gardinier, Nicksa & Cote, p. 1319).

They go on to quote the International Police Chief’s Association as saying,

“The determination that a report  of sexual assault is false can be made only if the evidence establishes that no crime was committed or attempted. This determination can be made only after a thorough investigation. This should not be confused with an investigation that fails to prove a sexual assault occurred. In that case the investigation would be labeled unsubstantiated. The determination that a report is false must be supported by evidence that the assault did not happen” (IACP, 2005b, pp. 12-13; italics in original).

So, in other words, the researchers who support this claim are saying that in only 2-8% of reported sexual assaults is it formally established that no assault took place.  They ARE NOT saying that in 92-98% of cases the person accused is guilty.  Within that 92-98% of remaining cases, there are still the possibilities that the woman is mistaken about who attacked her, that she was assaulted but is lying about who assaulted her, and those cases where she is lying about being assaulted, but the court cannot establish that this is a lie.

Let’s remember that the goal of a prosecution is not to establish every specific fact that pertains to a case, but rather to establish the guilt of the accused.  If the person accused is in fact innocent, then the allegation made against them was false, regardless of whatever other details may be true with respect to the accuser.  What then are the statistical facts with respect to those men that are accused of sexual assault?

One study by Eugene Kanin of Purdue University found that 41% of all sexual assault allegations are false, when it is understood that by this it means that the person accused of the crime was innocent (Kanin, 1994).  However, Kanin’s study has been widely criticized.  This in and of itself does not make his conclusions wrong, but let’s consider an alternative, less controversial source.

According to the Federal Bureau of Investigation (FBI), in cases involving sexual assault, DNA evidence is able to exonerate the accused in at least 20% of cases, and it is exculpatory to the accused in at least 40% of cases (McElroy, 2006).  For those not familiar with legal terminology, exonerate means the innocence of the accused is established, and exculpate means that doubt is cast on their guilt to the point that they cannot be convicted, even if it does not conclusively demonstrate their innocence.  Also, don’t forget that this is simply referencing the use of DNA evidence and leaves open the possibility of other exculpatory evidence of a different nature.

The person claiming that sexual assault allegations are false only 2-8% of the time usually intends for the hearer to conclude that in 92-98% of cases, the person accused is guilty.  The reality is that in 20% of cases the accused is innocent, and in at least 40% of cases there are serious reasons to doubt his guilt.  False allegations of sexual assault are frequent enough that it is appropriate to call them common.

However, even if this were not the case, the fact remains that one must not assume innocence or guilt based on statistics.  Women are not saints who never lie, and not all men commit sexual assault.  Every case must be assessed on it’s own merits, the accused is innocent until proven guilty, and the burden of proof is on the party making the positive claim.

Many people today believe that gender roles are fluid, and that traditional gender roles are simply outdated stereotypes designed to oppress women. However, research and common sense strongly suggest that traditional gender roles are fundamental marriage and the family, benefiting all parties when they are embraced. James Allsup Defends Big Government by Attacking Big Government? (Part 1)

Commentator James Allsup has made a video defending why we need big government in order to serve the people. The Bachelorette’s Hannah Brown is Why Men Don’t Want Marriage

Former pageant queen Hannah Brown doesn’t think it’s reasonable to expect her to not to have sex with multiple men.

I’ve never personally watched The Bachelor or The Bachelorette.  However, after this season of The Bachelorette made headlines everywhere due to the “sex argument” between Bachelorette Hannah Brown and contestant Luke Parker, I couldn’t resist but to look into it.  Here’s a quick summary of what happened on this past Monday’s episode by Lisa Respers France at CNN,

It all started when he [Luke Parker] told Brown that while he’s not a virgin, he’s been abstinent for the past four years because of his religious beliefs and he wanted the same for her.

Saying he was “very confident that were on the same page with our morals and I just want to hear it from your mouth,” Luke P. wanted assurances that there would be no hanky panky between her and the three other men left in the competition.

“Like, I totally have all the trust in the world for you but at the same time I just want to make sure we’re on the same page,” he said. “Like, if you told me you’re going to have sex or you had sex with one or multiple of these guys I would be wanting to go home 100 percent.”

Brown didn’t love the way the conversation was going.

“It’s just that you’re questioning me and you’re judging me and feel like you have the right to when you don’t at this point,” she said. “And I get when you care for somebody that you don’t want to think about somebody being intimate with another person. But guess what, sex might be a sin out of marriage, pride is a sin, too, and I feel like this is a pride thing.”

Brown eventually asked Luke P. to leave, but he wouldn’t move, telling her, “I feel like you owe me at least a minute to share my heart.”

Further, in an interview with People, Hannah stated she felt that she is being “slut-shamed.” She was also clear earlier in the season, that despite the fact that she is a Christian, she engages in premarital sex and doesn’t have even the slightest qualms about it. Those of you who have followed my content for awhile have likely seen the videos I’ve made in response to Katie Emmerson, Tiffany Dawn, and others in which I explain that a person’s sexual history is extremely important when it comes to relationships, especially a lifelong commitment like marriage. To be clear, I support the rights of everyone to make their own decisions about sex and relationships provided no one else’s rights are being violated in the process. However, having the freedom to make your own decisions about sex does not change the fact that such decisions have consequences and that no one has a moral obligation to ignore those consequences when considering you as a marriage partner.

This is why I have to say that Luke Parker dodged a huge bullet by not winning The Bachelorette. I’m also virtually certain that whoever does win will see his marriage to Hannah crash and burn within a few years, if not earlier. Hannah displays an all too common attitude among women these days that is making more and more men turn away from marriage. She seems to think that relationships are all about her and doing what makes her happy.

In ages past, it was understood that marriage was unique from every other kind of relationship, and that both husbands and wives had obligations to one another. To be sure, various cultures have had nuanced views about precisely what these obligations were, but there were obligations. A young person’s capacity to be a husband or a wife could be directly evaluated based upon their capacity to perform the duties of a husband or a wife, and making such judgements about a potential spouse was not only acceptable but encouraged.

However, thanks to modern feminism, many women now believe that they have only one responsibility in marriage and in life, and that is to be happy. Does having casual sex with multiple men make you happy? Then you go girl! Does putting your career before your marriage make you happy? Then you go girl! Does the idea of getting a divorce make you happy? Then you go girl!

How does this attitude play out when selecting a marriage partner? Well women are certainly free to have whatever standards they’d like for their men. After all, it’s about her being happy. But men on the other hand better not have ANY expectations for their women. This would be judgmental, and you guessed it, that would make her unhappy.

As sad as it may seem, this is the reality of the world we live in. If a man fails to provide for his family, cheats on his wife, or neglects his children, society will have no problem calling him a deadbeat, regardless of how unhappy he may be. However, if a woman does precisely the same, it must be the fault of her husband. He must’ve somehow driven her away, and more than that, made her unhappy. Divorce courts regularly reward women with cash and other incentives for initiating divorce, regardless of how frivolous her reasons for the divorce. Female happiness is the supreme good.

So, what does this have to do with Bachelorette Hannah Brown?  Well for one, Luke Parker’s desire that she remain chaste until marriage is not a purely religious concern.  Studies have shown overwhelmingly that the number of sexual partners a woman has prior to marriage correlate with the likelihood that she will divorce once married.  It is not at all unreasonable that Luke should want Hannah to avoid having sex before marriage if he genuinely wants to marry her, since this is an important indicator of whether or not their marriage would be a success.

However, even if this were not the case, Hannah’s willingness to sleep with multiple men on a show that’s supposedly about finding a husband speaks volumes to what her behavior as a wife would be like. It should be no surprise to anyone that the best indicator of a person’s future behavior is their past behavior. What then do Hannah’s actions say?

If Hannah is willing to have sex with multiple men today, do you really think that’s going to magically change once a ring slips onto her finger? Hannah openly admitted that the God she claims to follow disapproves of premarital sex. But it doesn’t matter, Jesus loves her anyways. If she so easily disregards the commands of her God in order to do what feels good in the moment, what kind of respect could she possibly have for the wishes of her husband? Will she say no to extramarital affairs, squandering her husband’s income, or neglecting children in favor of fun and thrills?

I have to ask. Why would ANYONE, Luke Parker or otherwise, want to marry someone with this kind of attitude? What possible benefit could there be to legally latching yourself to this level of narcissism?

It’s no wonder that more and more men are choosing to turn away from marriage all together. When women like Hannah Brown spout this attitude on national television and get praised for it, young, impressionable women go on to emulate her. As time goes on, men appropriately recognize the risks of marrying such women, and turn away from it altogether.

Wintery Knight says it best,

Most men are not interested in committing to, or discussing commitment with, women who put pleasure above self-control. Most non-Christian men will have sex with a hedonistic woman, but they are too smart to ever commit to them. Why would a man commit to a narcissist? If a man’s role is just to please the “huge feminist”, then there is no reason to commit to her and be the slave of her selfish impulses for the rest of his life. Radical feminists believe that relationships are about their plans and their needs. They are not interested in responsibilities, expectations or obligations to men or to children. Most men, even secular men, understand that they must not marry a woman who rejects moral obligations for fun. Especially with the looming threat of no-fault divorce.

Congratulations Luke Parker. You might be slandered in the media, but you’re the real winner of The Bachelorette.

According to the About section of Means TV’s YoutTube channel, their content “seeks to uplift working people and showcase topics that affect us all, but that the corporate media often neglect.” Sadly, I have found them to be yet another channel full of soundbites of Marxist propaganda.
