Medicine is Scarce. Deal With It!

Representative Alexandria Ocasio-Cortez thinks that government can make healthcare services appear with the flick of a pen.

In a fit of genius, economist Thomas Sowell (1994) once said, “The first lesson of economics is scarcity: There is never enough of anything to satisfy all those who want it. The first lesson of politics is to disregard the first lesson of economics.”

Perhaps it should be called the Politician’s Economic Fallacy, but in this widely shared clip, Representative Alexandria Ocasio-Cortez (AOC) demonstrates just how true this is, especially with regards to industries that concern the entire population such as medical care.

The Nature of Demand for Medical Care

To be fair, there is an element of truth to what AOC says.  Every person values their own life more than they value most of the goods and services that they exchange on a daily basis.  A new computer won’t do you any good if you aren’t alive to use it, and so if it came down to choosing whether to spend your money on a new computer, or to spend it on a surgery that will prevent an otherwise fatal ailment, all but the insane would choose to pay for the surgery.

But this is hardly a meaningful observation from an economic perspective.  All this says is that under circumstances where a person’s life is at stake, they have a greater demand for life-saving medical treatment.  Whether or not you want to call a person’s life a commodity doesn’t change the fact that medical services are a scarce resource.

Scarcity Applies to Medical Care

The real cost of any medical treatment is the amount of resources needed to provide it and what other things those resources could have been used to do.  There are the chemical compounds that are used in the manufacture of medication, the knowledge and expertise of the doctors and nurses who administer it, the administrative work required to keep a hospital functioning, and so on and so forth.

Those same chemical compounds could have been used to manufacture a different medication or something else not medically related.  The auto parts used to manufacture an ambulance could have been used to build a firetruck, police cruiser, or a pickup truck.  A doctor could have chosen to go to school to be an engineer or a lawyer.  Therefore, regardless of how urgent it may be to have specific amounts of specific medical treatments at specific locations, it does not change the fact that medical services are governed by the same laws of supply and demand that govern any other industry.

The “Need” for Medical Care

In addition, matters of life and death in the healthcare industry are not always so cut and dry.  With many health conditions, there may be treatments available that could be “life-saving” but without any guarantee that they will be life-saving (dangerous surgeries, cancer treatments, etc.).  Once expended, those resources are gone, but the patient may lose his life anyways.  Beyond that, the same treatment that may extend the life of an elderly person by two years, could potentially extend the life of a young person by sixty years.

What then is the best way to distribute these scarce resources that have multiple uses?

Higher Prices Signal Higher Demand and Encourage Innovation

The answer is that if individuals are allowed to seek their own medical care based on what they are willing to pay for it, even lifesaving medical care will become increasingly affordable.  To borrow AOC’s own example, the cellphone was once as thick as a brick, with low battery life, and costing nearly $4,000.  Thanks to supply and demand and competition among providers, more than 96% of Americans now own cellphones, some 81% of which are smartphones.  The same is true with the costs of elective healthcare procedures like lasik eye surgery and cosmetic surgery.

As author Julian Adorney (2017) has stated, “Putting patients in charge of their own healthcare encourages them to be price-conscious. When this happens, service providers have an incentive to compete on price, and competition produces downward price pressure.”  In other words, when you pay for your healthcare as opposed to government or some insurance company, you decide what costs and risks are worthwhile.  This ensures that scarce medical resources flow to their most valued uses overall. Meanwhile, prices seek equilibrium where the amount of a given healthcare service demanded matches the amount available.

Government Intervention Prevents Price Signals from Working

When government steps in and seeks to cover costs for all its citizens with stolen tax money, the costs and risks associated with healthcare cease to matter to consumers, and demand for healthcare services essentially becomes infinite. But this does not change the fact that there is still a limited supply of resources, and those resources have multiple uses.  Now government must decide who gets to have what healthcare services and when, and government can never do this as efficiently as consumers.

This is why universal healthcare systems like Britain’s National Healthcare Service (NHS) are characterized by long wait times and poor service.  Even if it is true that overall costs for particular treatments are cheaper in such a system, what good does that do if you can’t receive those treatments before it’s too late?

Politicians Know That Their Empty Promises Lead to Votes

Of course, as Thomas Sowell’s quote implies, the fact of the matter is that politicians like AOC don’t make a fuss about life saving medical care out of any genuine concern for the people.  They do it to secure votes and further their own interests.

No matter how many times the government fails to deliver on its promises, and no matter how much an honest analysis shows that it can’t even in principle do so, people continue to trade in their freedom for these empty promises. Never having to concern oneself with healthcare needs again sounds good to voters but never actually occurs following elections.

When will we learn?

Are Gun Manufacturers Responsible for Mass Shootings?

On November 12th, 2019, the US Supreme Court rejected an appeal from the Remington Arms Company which argued that the company could not be sued for the criminal misuse of its firearms under federal law. Now, family members of those who died in the 2012 Sandy Hook Massacre will be able to proceed with their lawsuit against Remington, in which they argue that the gun manufacturer is responsible for the mass shooter’s actions. They justify this claim on that basis that the company negligently marketed a dangerous weapon to the general public. But where exactly does this line of reasoning lead to?

Kate Hill’s Feminist Fail

On October 27th, 2019, freshman Democratic representative #KatieHill announced she would be stepping down from her position in Congress amid allegations of a sexual affair with her male legislative director and the publication of nude photographs and other materials substantiating separate allegations of a sexual affair with one of her female Congressional staffers. In the age of #MeToo, we’ve constantly been lectured about how utterly unacceptable it is for employers to have sexual relationships with their subordinates, as the imbalance of power makes it impossible for the subordinates to consent. However, Katie Hill, and a slew of media outlets, are now attempting to make her the victim, the only crime here being the crime of revenge porn. But what is the lesson that we should be learning from Katie Hill, and is she really the victim here?

The Case for Private Police

Could privatizing police services resolve many current issues with public law enforcement?

As you go about your daily life, I’m sure you’ve seen two different kinds of people wearing a badge. The first is the public law enforcement officer we’re all familiar with. Citizens pay taxes to the government in order to fund this officer’s activity, and we’re told that his department exits to protect and serve the community.  The other is a private security guard. His activity is funded by the private entity that desires his services, and his department exists to protect and serve the interests of that private entity.

While government regulations carefully distinguish between the roles and responsibilities of public law enforcement officials and private security professionals, they share a common motivation for their activities that makes them exactly the same in principle. That is that all police and/or security services, public or private, exist to protect the interests of their clients. In other words, they answer to the people who pay them, and they are held accountable only in as much as they fail to serve those interests.

In the case of private security this should be very obvious. Consider any common business where you’re likely to see private security guards.  For example, most privately-owned shopping malls employee such services.

Shopping malls employee private security because they have a vested interest in ensuring that merchandise is not stolen from their clients. They also have need to ensure that their customers feel safe and secure as they go about their shopping. However, shopping malls also have a vested interest in holding their security staff accountable.

If security guards are routinely rude and disrespectful to patrons of the mall, those patrons are unlikely to continue shopping there, and the mall will cease to be profitable. Further, if the rules that the mall asks its security staff to enforce are too restrictive and displeasing to patrons of the mall, patrons are again unlikely to keep shopping there.  The mall will again cease to be profitable, and thus the interests of the malls patrons are necessarily intertwined with the mall’s interests.

For this reason, every private security professional understands that his primary objective is to ensure that his client, in our example the shopping mall, has his interests protected. If the security professional fails in this mission, his client will quickly dismiss him in favor of a different security professional or firm that can do a better of job of protecting his interests.

But what about public law enforcement?

Undoubtedly, there are those in the community who donate their private funds to police causes, but at the end of the day, citizens are coerced into paying taxes, which are then allocated to the various branches of government by the state, including law enforcement agencies. If citizens are displeased with the police services they are receiving, they can write their elected officials and express this, or call the law enforcement agency directly and file a complaint, but they cannot dismiss public law enforcement officials for dereliction of duty as they could private security professionals that they were employing directly. The only entity that can dismiss public police officers is the state itself.

For this reason, the public police officer, just like his private security counterpart, realizes that he has an obligation to protect the interests of his client. However, his client’s interests are unique in that the state is never under threat of losing profitability because of displeased patrons. Citizens will be forced to pay their taxes whether they want to or not.

Consider then the practical consequences, when law enforcement fail in their responsibility to protect and serve the community.

In 1981, the court case Warren vs. District of Columbia was brought before the District of Columbia Court of Appeals. This case involved three women who had horrific crimes committed against them by men who forcibly broke into the building in which they lived. While two of the appellants had contacted the D.C. Metropolitan Police Department when the break-in began, dispatch and patrol officers failed to follow multiple department procedures. Despite arriving at the scene, officers did not investigate beyond knocking on the door, and then departing when there was no answer. As a result, a crime that could have been stopped within minutes of its beginning became a series of horrific crimes that lasted 14 hours.

The women who had endured these crimes sued the District of Columbia on the basis that Metro P.D. had failed to follow its own procedures, and in so doing, failed in its stated mission to protect the community from crime. However, the court ruled against the appellants stating,

“A publicly maintained police force constitutes a basic governmental service provided to benefit the community at large by promoting public peace, safety and good order. The extent and quality of police protection afforded to the community necessarily depends upon the availability of public resources and upon legislative or administrative determinations concerning allocation of those resources…” (Warren v. District of Columbia, 1981).

The court went on to say,

“At any given time, publicly furnished police protection may accrue to the personal benefit of individual citizens, but at all times the needs and interests of the community at large predominate. Private resources and needs have little direct effect upon the nature of police services provided to the public. Accordingly, courts have without exception concluded that when a municipality or other governmental entity undertakes to furnish police services, it assumes a duty only to the public at large and not to individual members of the community” (Warren v. District of Columbia, 1981).

In other words, the court was very clear that police do not exist to protect individuals. They exist to protect the state. Granted, the state attempts to hide this fact by broadcasting the idea that police exist to protect “the community” but the community is nothing more than a collection of individuals. It may be the case that the state’s interests and individual interests happen to align in many circumstances, but the fact that individuals have their interests protected by police in some circumstances is nothing more that a fortunate side effect. Whether the police officers themselves realize it or not, they are always acting in the state’s interests and will do so in any case where the state’s interests conflict with individual interests.

This is not the fault of police officers themselves, but of the incentive structures that are created by coercive taxation. There is no reason that public law enforcement services could not continue to exist as private entities. Whether individually, or as members of a neighborhood, private entities could employ private police firms to protect their own interests, just as many businesses do every day. In a free market, this would lead to competition among private police firms in which only those firms that provided the highest quality service for the lowest possible price would survive. If at any point, you were displeased with the police services being provided, you could fire your current firm, in favor of another, better quality one.

At this point, it is important to be absolutely clear that police officers themselves are not the enemy. It is undoubtedly true that many brave men and women have chosen to become police officers out of a genuine desire to protect their communities from harm. It would be wrong to dismiss the fact that police officers can and often do protect innocent people from harm.

However, when police brutality and other misconduct do occur, it is symptomatic of the incentive structures that exist within all tax-funded, state services. Because public police services answer to the state and not directly to the people, they will never have the same incentives regarding public perception and satisfaction that private security services do. Further, the state always has the incentive to use the police to further its own interests, even when that means ordering them to violate the rights of its citizens.

In summary then, all police and/or security services, public or private, exist to further the interests of their clients. As such, publicly funded police services will always serve the interests of the state, not individuals within their community. It will be impossible to quell the corruption that results from these incentive structures except via a free market solution, the complete privatization of police and security services.

The Truth about Amazon’s “Our Positions” Paper

Recently, e-commerce giant #Amazon released a document titled “Our Positions,” in which they laid out the company’s official stances on public policy issues such as the federal #MinimumWage, #Immigration, and #DiversityandInclusion in the workplace. Unfortunately, while Amazon may claim that it advocates government regulations for the good of the people, careful analysis reveals that it is doing nothing more than advocating for regulatory capture to force its competition out of the market and grant itself a de facto state enforced monopoly. In this video, Nate the Voluntaryist, Nightshift10000, and myself analyze each policy point of Amazon’s paper and show this to be so.

Gun Licensing Will Not Stop Gun Violence (Vox Debunked)

Senator Cory Booker recently claimed that firearm licensing laws have been proven to cut homicides by up to 40%. Vox has now stepped up to defend this claim, citing data from Connecticut and Missouri, as well as speaking to the ineffectiveness of background checks. Unfortunately, per the usual, Vox is cherry picking data to support the #GunControl agenda, and when examined in light of all relevant facts, their claims ring hollow. This video is a response to Vox’s video “The gun solution we’re not talking about,” originally released on September 11th, 2019.

Are Only 2% of Sexual Assault Allegations False?

Actress Alyssa Milano has been among those espousing that only 2% of sexual assault allegations are false.

Ever since the #MeToo controversy broke out, there’s been a commonly repeated claim made across the social media sphere that only 2 to 8% of sexual assault allegations are false, and that because such a low number of reports are false, we ought to always believe women who report they were assaulted by default.  Even if not explicitly stated, what the people who report this are really saying is that since false allegations are so rare, the burden proof ought to be on the accused male to prove that he didn’t assault the female who is accusing him, not on the accuser to prove that he did. Even if the courts are ultimately unable to establish that he did commit the assault, we ought to assume he did anyways.

I should first point out that even if it is the case that only 2-8% of sexual assault allegations are false, it does not follow that we should therefore assume that all reports are true.  Every case needs to be evaluated on its own merits, the accused is innocent until proven guilty, and the burden of proof is on the person making the positive claim that it did happen.  If you deny this then you are denying your own right to due process the next time you are accused of committing a crime.

However, when you actually read from the studies that make this claim, it becomes clear immediately that specific definitions researchers are using have been chosen so as to make it seem like men are guilty of sexual assault far more often than they actually are.  So, let’s quick talk about the various possibilities that exist when a woman accuses a man of sexual assault.

When a woman claims she was sexually assaulted there are three possibilities about her claim.  Either she’s telling the truth, she’s deliberately lying, or she is sincerely mistaken for one reason or another.  But these three possibilities apply not only to her claim about the assault but also to her claim about who assaulted her.  It’s entirely possible, for example, that a woman was in fact sexually assaulted, but for one reason or another is mistaken about who assaulted her, and in such a case the woman would be telling the truth when recounting her assault, but none the less falsely accusing an innocent man.

But there are more possibilities as well.  There in principle could be a case where a woman was in fact sexually assaulted, but has chosen to accuse someone other than the person who assaulted her.  I don’t presume to know what the reasoning for that would be, but it is something that in principle could occur.  Now in this case, a woman could be truthfully recounting a sexual assault, but deliberately accusing a man who did not commit it.

As you can see, this issue is not as simple as either the accuser was assaulted by the person she is accusing, or she was not assaulted at all and is lying.  There are other possibilities, and very rarely will an investigation be able to definitively rule out all possibilities beyond the specific guilt or innocence of the accused.  For example, suppose in a particular case where a man is accused of sexual assault, evidence is presented that completely exonerates him, such as security camera footage that proves he wasn’t even in the city that the alleged assault took place in on the night it occurred.  In such a case, it would be established that the accused is innocent, but that doesn’t necessarily prove that no sexual assault occurred.  At this point the accuser could try and claim that she must’ve been mistaken about who assaulted her.  The innocence of the accused is not in and of itself, an admission by the accuser that no sexual assault occurred.

With all this in mind, what do the academics who have reported the 2-8% statistic actually mean when they say that only 2-8% of sexual assault allegations are false.  In their paper that was published in Violence Against Women and presented at the Symposium on False Rape Allegations, the researchers who made this claim said very clearly what they meant, “To classify a case as a false allegation, a thorough investigation must yield evidence that a crime did not occur” (Lisak, Gardinier, Nicksa & Cote, p. 1319).

They go on to quote the International Police Chief’s Association as saying,

“The determination that a report  of sexual assault is false can be made only if the evidence establishes that no crime was committed or attempted. This determination can be made only after a thorough investigation. This should not be confused with an investigation that fails to prove a sexual assault occurred. In that case the investigation would be labeled unsubstantiated. The determination that a report is false must be supported by evidence that the assault did not happen” (IACP, 2005b, pp. 12-13; italics in original).

So, in other words, the researchers who support this claim are saying that in only 2-8% of reported sexual assaults is it formally established that no assault took place.  They ARE NOT saying that in 92-98% of cases the person accused is guilty.  Within that 92-98% of remaining cases, there are still the possibilities that the woman is mistaken about who attacked her, that she was assaulted but is lying about who assaulted her, and those cases where she is lying about being assaulted, but the court cannot establish that this is a lie.

Let’s remember that the goal of a prosecution is not to establish every specific fact that pertains to a case, but rather to establish the guilt of the accused.  If the person accused is in fact innocent, then the allegation made against them was false, regardless of whatever other details may be true with respect to the accuser.  What then are the statistical facts with respect to those men that are accused of sexual assault?

One study by Eugene Kanin of Purdue University found that 41% of all sexual assault allegations are false, when it is understood that by this it means that the person accused of the crime was innocent (Kanin, 1994).  However, Kanin’s study has been widely criticized.  This in and of itself does not make his conclusions wrong, but let’s consider an alternative, less controversial source.

According to the Federal Bureau of Investigation (FBI), in cases involving sexual assault, DNA evidence is able to exonerate the accused in at least 20% of cases, and it is exculpatory to the accused in at least 40% of cases (McElroy, 2006).  For those not familiar with legal terminology, exonerate means the innocence of the accused is established, and exculpate means that doubt is cast on their guilt to the point that they cannot be convicted, even if it does not conclusively demonstrate their innocence.  Also, don’t forget that this is simply referencing the use of DNA evidence and leaves open the possibility of other exculpatory evidence of a different nature.

The person claiming that sexual assault allegations are false only 2-8% of the time usually intends for the hearer to conclude that in 92-98% of cases, the person accused is guilty.  The reality is that in 20% of cases the accused is innocent, and in at least 40% of cases there are serious reasons to doubt his guilt.  False allegations of sexual assault are frequent enough that it is appropriate to call them common.

However, even if this were not the case, the fact remains that one must not assume innocence or guilt based on statistics.  Women are not saints who never lie, and not all men commit sexual assault.  Every case must be assessed on it’s own merits, the accused is innocent until proven guilty, and the burden of proof is on the party making the positive claim.
